Terms of Service

By accessing or using Deskartify, you agree to these Terms of Service. If you do not agree, do not use the platform.

Deskartify provides software and hosted tools for digital commerce and marketing, including creator storefronts, shops, checkout pages, sales funnels, newsletter capture, CRM features, digital product delivery, subdomain hosting, analytics, and AI-assisted content generation.

Deskartify provides the platform infrastructure. Unless we expressly state otherwise, Deskartify is not the seller of a creator's products, is not the merchant of record for a creator's independent storefront or funnel, and is not responsible for the creator's business operations, promises, or customer communications.

To use certain features, you must create an account and keep your credentials secure.

• You must provide accurate and current information.
• You are responsible for all activity under your account.
• You must promptly update your account details when they change.
• You must notify us if you believe your account has been compromised.

If you publish a storefront, shop, checkout page, funnel, newsletter form, subdomain, or other public experience through Deskartify, you are solely responsible for it.

• The products, services, claims, prices, promotions, upsells, and guarantees you publish.
• The legality, accuracy, safety, and suitability of your content and offers.
• Customer support, fulfillment, refunds, disputes, and chargebacks relating to your offers.
• Required licenses, tax compliance, disclosures, privacy notices, and customer consents.
• Any emails, lead capture flows, CRM outreach, or follow-up messages you send to visitors.

Deskartify is a platform provider only. We do not review or approve every storefront, funnel, checkout page, product, or marketing claim, and we are not liable for creator-generated or creator-published materials.

You may not use Deskartify to:

• Violate any law, regulation, court order, or third-party right.
• Upload, sell, or promote infringing, unlawful, fraudulent, harmful, or deceptive content.
• Make false earnings claims, false medical or legal claims, or other misleading statements.
• Use fake endorsements, deceptive testimonials, impersonation, or misleading review practices.
• Collect personal data without proper notice, consent, or lawful basis where required.
• Send spam, malware, phishing content, or abuse our systems or third-party integrations.
• Attempt unauthorized access, reverse engineer restricted systems, or bypass platform limits.

You retain ownership of content you submit to Deskartify, subject to any rights of third parties. You grant us a non-exclusive, worldwide license to host, process, copy, display, transmit, and modify that content as needed to operate, secure, improve, and provide the platform.

You represent that you have all rights necessary to upload, publish, sell, or otherwise use your content and offers.

AI-generated outputs may be incomplete, inaccurate, offensive, non-unique, or unsuitable for your intended use. You are responsible for reviewing, editing, and verifying all AI-generated output before publishing or relying on it.

Deskartify does not guarantee that AI-generated content is lawful, accurate, non-infringing, or fit for any particular purpose.

Certain features require payment, a subscription, or both. By purchasing or subscribing, you agree to pay applicable fees and authorize recurring charges when your plan renews, unless you cancel before renewal.

• Fees are generally non-refundable except as required by law or an express policy.
• We may change pricing or plan limits prospectively.
• Third-party processors may impose their own terms and fees.

Deskartify may integrate with third-party hosting, storage, payment, email, analytics, domain, or AI providers. Your use of those services may also be governed by their separate terms and policies. We are not responsible for third-party services or for losses caused by them.

Deskartify is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, security, and accuracy.

We do not warrant any sales results, conversion rates, legal compliance, earnings, traffic, delivery success, or uninterrupted operation of storefronts, funnels, checkouts, CRM workflows, subdomains, or AI features.

To the fullest extent permitted by law, Deskartify and its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, customers, goodwill, use, or data.

We are also not liable for claims arising out of or related to creator storefronts, funnels, checkout pages, products, pricing, marketing claims, lead capture, CRM outreach, customer disputes, payment disputes, chargebacks, taxes, regulatory issues, or creator content.

If liability is nevertheless imposed on us, our total liability for all claims arising out of or relating to the service will not exceed the total amount you paid to Deskartify for the relevant service in the 12 months before the event giving rise to the claim.

You will defend, indemnify, and hold harmless Deskartify and its affiliates, officers, employees, and contractors from any claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your content, products, storefronts, funnels, checkout pages, or subdomains.
• Your violation of these Terms or applicable law.
• Your dealings with customers, leads, subscribers, or third parties.
• Any allegation that your content, offer, or activity infringes or violates another party's rights.

We may suspend, restrict, remove content from, or terminate your access to Deskartify at any time if we believe your activity creates legal exposure, security risk, operational risk, or violates these Terms.

We may remove or disable storefronts, funnels, checkout pages, products, assets, or subdomains in response to complaints, legal requests, suspected violations, or risk to the platform.

We may update these Terms from time to time. Material changes become effective when posted or when otherwise communicated to you. Continued use of Deskartify after the effective date means you accept the updated Terms.
